SCOTT COUNTY FISCAL COURT ORDINANCE NO. 19-04 AN ORDINANCE REGULA TING SOLID WASTE TRANSFER FACILITIES WHEREAS Pursuant to KRS 67 .083 , the Fiscal Court of Scott County may enact ordinances pertain i ng to the abatement of public nuisances; public sanitation and vector control ; conservation , preservation and enhancement of natural resources including soils, water , air, vegetation , and wildlife; regulation of commerce for the protection and convenience of the public; and exclusive management of solid wastes by ordinance or contract or by both and ; WHEREAS , to ensure that the citizens of Scott County are protected from the nuisance conditions associated with the inappropriate location of solid waste transfer facilities , the Fiscal Court has determined that same must be subject to reasonable regulation by the County; and WHEREAS , presently there does not exist in Scott County an ordinance regulating where transfer facilities may be located ; and WHEREAS , the regulations of the Ener gy and Environment Cabinet regarding the siting and management of solid waste transfer facilities represent minimum standards that may be augmented by the exercise of the authority of the Fiscal Court of Scott County pursuant to KRS 67 .083(3) and KRS 67.083(6)(b) ; and WHEREAS the Fiscal Court of Scott County is empowered by KRS 67 .083(6)(c) to adopt ordinances which incorporate by reference state statutes and administrative regulations in areas in which a county government is authorized to act, and is additionally empowered by KRS Chapters 109 and 224 to regulate solid waste management; and WHEREAS the Fiscal Court of Scott County desires to create this ordinance for
