SCOTT FISCAL COURT ORDINANCE NO . 21- 01 THIRD AMENDMENT TO AN ORDINANCE RELA TED TO THE EST ABLISHMENT OF GENERAL RULES GOVERNING THE APPOINTMENT AND TERMS OF BOARD COMMISSIONS WHEREAS, the Scott Fiscal Court approved Ordinance No . 99-10 on October 14, 1999 establishing general rules governing the appointment and terms of boards and commissions; and WHEREAS, said Ordinance was amended by the Scott Fiscal Court on July 23, 2009 by Ordinance No. 09-04; and WHEREAS, said Ordinance was further amended by the Scott Fiscal Court on December 9, 2016 by Ordinance No. 16-09; and WHEREAS, it is not statutorily prohibited under Kentucky law to establish term limits for local air boards; and WHEREAS, the Scott Fiscal Court now desires to change the Ordinance to amend term limits for local air boards to no more than four (4) consecutive full-term appointments; NOW , THEREFORE, BE IT ENACTED BY THE SCOTT FISCAL COUR T THAT ORI NANCE NO . 99-10, AS AMENDED IN ORDINANCE NO. 09-04 OF THE CODE OF ORDINANCES AND AS FURTHER AMENDED IN ORDINANCE NO. 16-09 OF THE CODE OF ORDINANCES BE FURTHER AMENDED AS FOLLOWS AND NOTHING HEREIN SHOULD BE CONSTRUED AS AMENDING OR WAIVING ANY OTHER PROVISIONS OF ORDINANCE NO. 99-10 (AS AMENDED IN 09-04 AND 16-09). SECTION TWO: REGULA TIONS : E. (1) EXCEPT WHERE STAUT ORIL Y PROHIBITED and EXCEPT FOR LOCAL AIR BOARDS, when the full term of appointment to a Board or Commission is four (4) years, there shall be no more than two (2) consecutive full-term appointments. In the case of local air boards, specifically the Georgetown Scott County Airport Board, there shall be no more than four (4) consecutive full-term appointments.
