SCOTT COUNTY FISCAL COURT ORDINANCE NO. 20-01 AN ORDINANCE BANNING COMMERCIAL MOTOR VEHICLE TRAFFIC ON THE WEISENBERGER MILL BRIDGE WHEREAS, a new bridge has been constructed on Weisenber ger Mill Road between Scott County and Woodford County; and WHEREAS, in the past, commercial motor vehicles have used the bridge on Weisenber ger Mill Road and have caused damage to the bridge; and WHEREAS, the Woodford County Fiscal Court has banned commercial motor vehicles from using the bridge to preserve the same; and WHEREAS, the Scott County Fiscal Court desires to preserve the bridge as well; NOW THEREFORE, it is hereby ordained by the Scott County Fiscal Court as follows: SECTION 1. II Commercial Motor Vehicles are hereby banned from use of the W eisenber ger Mill Road Bridge. SECTION 2. " Commercial Motor Vehicle" as used in this Ordinance shall mean a motor vehicle or comb nation motor vehicle used in commerce that is: (a) Designed to carry property and have a gross vehicle weight rating as determined by federal regulation which has been adopted into cabinet administrative regulations pursuant to KRS Chapter 13A; (b) Designed to transport sixteen (16) or more passengers, including the driver; (c) Transporting hazardous materials and is required to be placarded in accordance with Title 49, Code of Federal Regulations, Part 172; or (d) Any other vehicle that is required by cabinet administrative regulation, pursuant to KRS Chapter 13A, to be operated by a licensed commercial
