SCOTT COUNTY ORDINANCE NO. 2018-03 AN ORDINANCE CHANGING THE ZONE FROM AN AGRICULTURAL (A-1) ZONE TO A CONSER VA TION (C-1) ZONE FOR 6.62 ACRES,MORE OR LESS, A PAR T OF THE BRADLEY -FORD PROPERTY LOCATED SOUTH OF MCCLELLAND CIRCLE WHEREAS, Ball Homes, LLC, on behalf of the Property Owners Louis and Rosemary Bradley , the Ford Farm Partnership I, LTD, and the FBO Alice B. Southworth T rust, has filed an application with the Geor getown-Scott County Joint Planning Commission (the "Joint Planning Commission") requesting a zoning classification -change for the subject property from Agricultural (A-1) zone to Conservation (C-1) zone of approximately 6.62 acres of property , lying south of McClelland Circle approximately 0.6 miles west of the intersection of McClelland Circle and Lexington Road (U.S. 25); WHEREAS, this zone change amendment was presented to the Joint Planning Commission at its scheduled meeting on September 13 th , 2018, and with a quorum present, the Joint Planning Commission having voted to recommend approval of the zone change request of the Property as, and as further evidenced by additional documentation provided to the County, including the staff report concerning the application; WHEREAS, the Scott County Fiscal Court has considered the evidence presented at the public hearing held by the Joint Planning Commission together with the recommendations of the Joint Planning Commission and its staff as set out in the records of Joint Planning Commission; WHEREAS, the Joint Planning Commission has made findings ( 1) that the proposed map amendment is in agreement with the community's comprehensive plan and (2) that the Planning Staf f is in agreement (see staff report); and WHEREAS, the Fiscal Court concurs in and adopts the findings of the Joint Planning Commission for the zone change and approves and accepts the recommendations of the Joint Planning Commission as set out in its records, together with the amended and additional conditions of approval that have been agreed to by the Applicant (the "Agreed Upon Conditions"), as set forth below; NOW THEREFORE BE IT ORDAINED BY THE SCOTT COUNTY FISCAL COUR T AS FOLLOWS: Section 1: That the Georgetown-Scott County Zoning Ordinance shall be amended to show a change in the zoning classification from Agricultural (A-1) zone to Conservation (C-1)zone, for 6.62 acres for the property more fully described in Exhibit "A" which is attached hereto and incorporated herein by reference. Section 2: That the Georgetown-Scott County Planning Commission is directed to show the amendment on the official zone map atlas and to make reference to the number of this
