3 40.2 O RDINANCE NO. 96-007 340.2 A N ORDINANCE RELATING TO D IRT, EARTH AND/OR DEBRIS D EPOSITED UPON A STR EE T OR HIGHWAY W HEREAS, in the interest of public safety certain r egulations are necessary, proper and required for the p revention of dirt, earth, and/or debris upon public highways i n S cott County, Kentucky, and W HEREAS, the Scott Fiscal Court, in order to promote the p ublic safety of the citizens of Scott County and safe t raveling thereon under the powers granted the said court by K RS 6 7.083 N OW, THEREFORE, BE IT ORDAINED BY THE SCOT T CO UNTY F ISCAL COURT OF SCOTT COUNTY, KENT UCK Y, AS FO LLOW S: S ECTION I: Any and all dirt, earth and/or debris from a ny r eal estate improvement within the county shall be kept a nd/or transported in such manner that it will not wash, d rain or otherwise be caused to enter and be deposited in or u pon a ny county street or highway, sewer or other drainage f acility of the county. S ECTION II: Any person, perso ns, partnerships, c orporations, contractors and/or builders who displace or r elocate or cause to be displaced or relocated any dirt, e arth and/or debris from any real estate improvement and s uch d isplacement or relocation places the dirt, earth or d ebris in such a manner that it washes, drains or is caused t o e nter and be deposited in or upon the county street, h ighway, sewer or other drainage facility of the county, s hall forthwith remove and relocate said dirt, earth and d ebris to a safe location and shall clean up or cause to be c leaned up said dirt, earth and debris within 24 hours. S ECTION III: Any person, persons, partnerships, c orporations, contractors or builders violating any p rovision of the preceding sections shall be guilty of a
