340.8 SCOTT FISCAL COURT ORDINANCE NO. 11-04 AN ORDINANCE RELA TING TO THE USE OF GREA T CROSSINGS PARK WHEREAS, in the interest of public health, safety and welfare certain regulations are necessary , proper and required to designate specific times that GREAT CROSSINGS PARK is open for public use and access; and WHEREAS, the Scott Fiscal Court in order to promote the proper use of said park under the powers granted to it by KRS 67.083 has decided to enact an ordinance: NOW , THEREFORE, BE IT ORDAINED BY THE SCOTT FISCAL COUR T, COMMONWEAL TH OF KENTUCKY, AS FOLLOWS: SECTION I: The GREAT CROSSINGS PARK shall be open to the public for recreational activities each day during the hours of sunrise to sunset. SECTION 2: The GREA T CROSSINGS PARK shall not be used at anytime for swimming and/or camping activities. SECTION 3: The Scott Fiscal Court shall post signs in the PARK in visible and noticeable locations that make reference to this ordinance, the hours for public use and access, and the prohibitions contained herein. SECTION 4: Recreational activities shall include fishing, boating, use of the park for picnics and other social activities consistent with this ordinance and Kentucky law . SECTION 5: Any person or persons violating any provision of the preceding subsections shall be guilty of a misdemeanor and upon conviction shall be fined not less than $50.00 nor more than $250.00 and/or incarcerated for no more than 90 days per offense. Each day during which such violation shall continue shall be considered a separate offense. SECTION 6: Should any part of this Ordinance be held invalid by a court of competent jurisdiction, then the portions not so affected shall be severable and continue to be in full force and effect.
