ORDINANCE NO . 20-04 AN ORDINANCE ESTABLISHING A HOME INCARCERA TION PROGRAM FOR THE SCOTT COUNTY DETENTION CENTER WHEREAS, persistent overcrowding has become a problem for the Scott County Detention Center; and WHEREAS, it would be beneficial for both the detention center and it's inmates to establish a home incarceration program that would remove inmates from the detention center, but still provide a monitored environment for them, and WHEREAS, K.R.S. 67.372 authorizes the fiscal court to create a home incarceration program by ordinance; and WHEREAS, the Scott County Fiscal Court has determined that creating a home incarceration program is in the best interest of the citizens of Scott County; NOW, THEREFORE, IT IS ORDAINED BY THE SCOTT FISCAL COUR T as follows: Section I: A home incarceration program (HIP) is hereby created pursuant to K.R.S. 67.372 As required by said statute, the Scott County Detention Center is the agency designated to monitor the HIP. Section II: The county shall enter into a contract with an appropriate entity to operate the HIP. Said contract shall be reviewed at least annually Section III: The county shall pay the expense of the operation of the HIP for qualified inmates, which shall be designated as a line item on the Scott County Detention Center budget. The Scott County Detention Center is also hereby designated as the agency to operate the HIP on a continuous basis, twenty-four (24) hours per day and seven (7) days per week. This shall be in conjunction with a third party contractor who shall carry out the day to day operations of the HIP. The Scott County Detention Center is authorized to formulate the policies and procedures necessary to operate the program as provided by the Kentucky Revised Statutes and this ordinance. Section IV: Pursuant to K.R.S. 67.372 (2) the fiscal court designates the Scott County Sherif f's Office as the law enforcement agency to assist a petitioner , victim or witness when a person ordered to wear a monitoring device violates the provisions of the court's order and is in need of assistance.
