SCOTT FISCAL COURT SCOTT COUNTY , KENTUCKY ORDINANCE NO. 04-02 AN ORDINANCE RELATING TO CHANGING THE ZONE FOR 23.498 ACRES, MORE OR LESS, OWNED BY SUE W . TONCRA Y, GEORGE T. BURGESS, BOB G. GRIFFITH AND LINDA W . REYNOLDS, (UNDER CONTRACT OF SALE TO MARKS. SMITH), SITUA TED ON THE WEST SIDE OF U.S. 25 NORTH AND THE NORTH SIDE OF WRIGHT LANE, SCOTT COUNTY , KENTUCKY , FROM AGRICULTURAL A-1 TO RESIDENTIAL R-lB (PUD). WHEREAS, the application (as amended) of Mark S. Smith, 104 Teal Court, Geor getown, Scott County , Kentucky 40324, having been filed with the Georgetown-Scott County Planning Commission on January 2, 2004, requesting a zoning classification change from Agricultural A-1 to Residential R-lB (Planned Unit Development) for 23.498 acres, more or less, situated on the west side of U.S. 25 North and north side of Wright Lane in Scott County , Kentucky; and WHEREAS, the matter having been heard publicly by the Planning Commission on February 12, 2004, and March 11, 2004, pursuant to notice according to law and with a quorum present and voting; and WHEREAS, after taking testimony on the application and fully considering same, the Planning Commission voted six (6) to two (2) to recommend to Scott Fiscal Court that the requested application be granted; and WHEREAS, Scott Fiscal Court, on the 9th day of APRIL 2004, after fully considering the application, record, and recommendation of the Planning Commission, voted to accept the Planning Commission's recommendation and granted
